Circumstances under with a Qadi may disqualify a person and appoint a guardian (Articles 119 -125)
differentiate between a simpleton (Dhu ghafla) and squanderer (Safih). The actions of the former are considered to be those of the mentally unstable, whose actions prior to being certified by the court as unstable are not binding, except if they are to his benefit (to the mentally unstable and simpleton); but the actions of the squanderer before his disqualification are binding. These differences do not exist in the Moslem Fiqh.
